Seizure of Nigerian Government Jet
Chinese company Zhongshang Fucheng Industrial Investment Ltd has seized a luxury jet belonging to the Nigerian government in Canada. The seizure is part of an aggressive campaign by Zhongshang to claim Nigerian assets abroad, following a legal dispute involving the company, the federal government of Nigeria, and Ogun State. A Canadian court ruled in favour of Zhongshang earlier this year, leading to the company taking custody of the Bombardier 6000 BD-700-1A10 jet.
Ongoing Legal Battle
The legal battle stems from a disagreement over arbitration awards owed by Nigeria to Zhongshang. The Chinese company, authorized to confiscate multiple Nigerian assets worldwide, has recently seized the jet, one of several such actions. Originally owned by fugitive Dan Etete, Nigeria confiscated the jet in 2016, detained it in Dubai, and later flew it to Canada.
Court Ruling in Favour of Zhongshang
In a significant ruling, Judge David Collier of the Superior Court of Quebec rejected Nigeria’s claims to retain ownership of the aircraft. The Nigerian government had argued that it could not respond to the lawsuit due to the February-March 2023 general elections, a claim the court found baseless. Nigeria’s assertion of sovereign immunity was also dismissed, aligning with earlier rulings by arbitration panels and courts in the United Kingdom.
Wider Implications for Nigerian Assets
This latest development highlights the broader implications for Nigerian assets abroad. Zhongshang has been systematically targeting and seizing assets linked to Nigeria as part of its efforts to enforce arbitration awards. This includes previous authorizations to seize three Presidential jets, further straining diplomatic relations between Nigeria and the involved countries.
