Dele Farotimi’s Book Controversy: Babalola Justifies Legal Action

Elder Statesman Seeks Justice
Aare Afe Babalola, SAN, has reiterated his commitment to protecting his reputation, following allegations made by activist lawyer Dele Farotimi. During a press conference in Ado-Ekiti on Friday, Babalola’s legal representatives stated that their client petitioned the police to investigate claims made in Farotimi’s book, Nigeria and its Criminal Justice System. Babalola aims to hold Farotimi accountable for defamatory remarks.

Legal Process Underway
The police arrested Farotimi in Lagos on Tuesday in response to Babalola’s petition and arraigned him before an Ekiti State Magistrates Court on Wednesday for defamation allegations. While Farotimi’s lawyer requested bail, the Chief Magistrate ordered his remand and adjourned the case until December 10, 2024.

Press Conference Highlights
Babalola’s lead lawyer, Owoseni Ajayi, stated during the press briefing that the lawsuit seeks to clarify misleading information in the public domain. Ajayi, a former Attorney General of Ekiti State, urged Nigerians to verify facts before forming opinions. He emphasised that the elder statesman is entitled to justice just like any other Nigerian, irrespective of his status.

Defamation Allegations Expand
Meanwhile, the police have filed additional charges against Farotimi at a Federal High Court in Ado-Ekiti. These charges relate to alleged cybercrime offences stemming from Farotimi’s online interviews. According to court documents, Farotimi accused Babalola of “corrupting the judiciary” during a podcast interview, which the police argue constitutes false information under the Cybercrimes Act.

A Call for Proof
Ajayi clarified that Babalola’s petition asks Farotimi to provide evidence supporting his allegations or face prosecution for criminal defamation. “The law allows free speech but prohibits statements calculated to harm another’s reputation,” he explained. The legal team further demanded the confiscation of defamatory materials pending the conclusion of investigations.
