Plea of Not Guilty Entered in Absence of Defendant
The Economic and Financial Crimes Commission (EFCC) has called for a plea of not guilty on behalf of former Kogi State Governor, Yahaya Bello, during a recent hearing at the Federal High Court in Abuja. This request comes amid allegations of misappropriation amounting to N80.2 billion, despite Bello’s absence from the proceedings.
Prosecution’s Two Key Applications
During the hearing, EFCC counsel Kemi Pinheiro (SAN) presented two applications to the court. The first application sought to formally enter a plea of not guilty for Bello, while the second involved the presentation of witnesses who were present in court. Pinheiro argued that the defendant has waived his right to appear physically, asserting that the court could proceed with the plea regardless of Bello’s absence.
Defence Counsel Opposes Prosecution’s Motion
Bello’s counsel, Michael Adoyi, opposed the prosecution’s application, stating that it contradicted a prior court order which mandated that the defendant must be present for any arraignment. Adoyi emphasized the need for the court to maintain its integrity and ensure that all proceedings adhere strictly to legal protocols. He highlighted that the prosecution’s approach risks undermining the judicial process.
Supreme Court Appeal Complicates Proceedings
Adoyi further pointed out that the matter of Bello’s arraignment is currently under appeal in the Supreme Court, indicating that any actions taken by the lower court could interfere with the appellate court’s decision. He urged the judge to postpone any decisions regarding the arraignment until the Supreme Court resolves the pending appeal, emphasizing the principle of justice.
Judge’s Response and Future Proceedings
Justice Emeka Nwite acknowledged the complexities involved in the case and indicated that a ruling on the EFCC’s application might not be forthcoming this year. He suggested that the court would need to adjourn for further deliberation on the matter. Consequently, the judge scheduled the next hearing for January 21, 2025, to address the prosecution’s plea and potential arraignment.
Multiple Charges Awaiting Resolution
Bello faces a total of 19 charges related to money laundering and misappropriation of funds in the ongoing case. Additionally, he is confronted with a fresh set of 16 charges totaling N110.4 billion, which will be heard by Justice Maryann Anenih. As the legal proceedings unfold, the EFCC remains resolute in its efforts to pursue justice for the alleged financial crimes.
