Federal Government Pushes for Local Government Autonomy

On Thursday, the Supreme Court held back judgment in a significant case filed by the Attorney-General of the Federation, Lateef Fagbemi (SAN), seeking full autonomy for Nigeria’s 774 local governments. This suit, marked SC/CV/343/2024, demands the enforcement of local government autonomy, aiming to prevent state governors from appointing caretaker committees to manage local governments.

State Governors Oppose FG’s Suit

In response, all 36 state governors opposed the Federal Government’s suit. They appealed to the court to dismiss the case, arguing that the Federal Government’s request undermines their authority. The Attorney-General, however, urged the court to grant all reliefs sought, insisting that local governments should operate independently without state interference.

Enforcement of Direct Funding

The Federal Government aims to secure a ruling to ensure the Federation Account funds are paid directly to local governments. This measure aims to guarantee financial independence and prevent governors from dissolving democratically elected local government councils. Justice Garba Lawal led the seven-man panel and announced that they would communicate the judgment once it is ready.

Allegations of Misconduct

In its submissions, the Federal Government accused state governors of gross misconduct and abuse of power. The government called for an order prohibiting the unilateral dissolution of local government councils by governors. This move is part of a broader effort to uphold constitutional provisions and enhance local governance.

AGF Defends Federal Government’s Position

The Attorney-General clarified that he served all necessary documents to the defendants through multiple channels, including WhatsApp and email, defending the Federal Government’s stance. He urged the Supreme Court to invoke relevant constitutional sections to ensure democratic governance at the local level.
