Hearing Delayed Due to Legal Representation Issues
The arraignment of former Kogi State Governor Yahaya Bello at the Federal High Court in Abuja was stalled on Friday due to the absence of his defence counsel, Abdulwahab Mohammed (SAN). Mohammed was reportedly unaware of the hearing date, resulting in his nonappearance. Bello faces a 19-count charge of money laundering totalling N84 billion, brought against him by the Economic and Financial Crimes Commission (EFCC).
EFCC Pushes for Arraignment
During the hearing, EFCC counsel Kemi Pinheiro requested that the court proceed with the arraignment in the absence of Bello’s lawyer. Pinheiro argued that the law only mandates the presence of the defendant, not necessarily their legal representation. However, Justice Emeka Nwite declined, citing the need to ensure fair hearing and adequate legal representation for the defendant.
Judge Defends Decision to Adjourn
Justice Nwite explained that proceeding without Bello’s counsel would be unfair, particularly since the defendant had stated that his legal team was unaware of the date. “Fair hearing is a cornerstone of justice,” the judge emphasised, adding that it would be inappropriate to move forward under the circumstances.
Previous Proceedings Highlight Tensions
At the previous hearing in October, Pinheiro urged the court to proceed with trial, as witnesses were present and ready to testify. The judge, however, had insisted on maintaining the scheduled date in January to ensure proper representation for the defendant. This week’s adjournment reflects continued efforts to uphold these principles.
New Date Scheduled
Following the adjournment, Justice Nwite directed that notices be served on Bello’s legal team and scheduled the next hearing for December 13. He also ordered that Bello remain in EFCC custody until then.
EFCC Reaffirms Commitment to Justice
The EFCC, through its counsel, reiterated its commitment to pursuing the case diligently. The commission emphasised that the charges against Bello are part of broader efforts to combat financial crimes and uphold accountability in public office.
